Abba Kyari Decline Ownership Of Properties

Suspended Deputy Commissioner of Police, Abba Kyari, on Monday, has denied allegation by the National Drug Law Enforcement Agency, linking him to the ownership of 14 assets, including shopping mall, residential estate, polo playground, lands and farmland, was untrue.

Kyari, a former Commander, Intelligence Response Team, in a statement by his lawyer, Hamza Tani on Monday, said the reports were orchestrated by the NDLEA to further tarnish his image.

According to him, the agency resorted to cheap blackmail because “NDLEA’s case in court against Abba Kyari and four others is not going well for them.

Kyari released the details of the money in his account.

They are N2.8 million in his UBA account, the only account he has been using for the past eight years; 7,000 pounds in GTB kept over eight years ago and N350,000 in GTB kept many years ago.

Others were N200,000 in Sterling Bank and Access Bank account not in use for over eight years.

His lawyer said:

They expected the court case to go smoothly in their favour the way their sponsored media trials went viral between February and April 2022. They failed to understand that unlike media trials, courts need real evidence and facts which NDLEA don’t have in this case.

By all means, out of desperation, again, NDLEA wanted to spoil Abba Kyari’s name at all cost because they know that all their initial efforts have failed as overwhelming majority of good Nigerians who want peace and security for the nation are still behind Abba Kyari despite the set-up by NDLEA against Abba Kyari in January 2022, which was followed by massive sponsored media trial earlier this year.

Again, NDLEA is sponsoring fabricated lies, untrue stories, and flimsy allegations, trumped-up and false charges in court without justification against Abba kyari.

He recalled that on August 29, 2022, Justice Inyang Ekwo of a Federal High Court in Abuja dismissed a suit filed by the Attorney-General of Federation to extradite Abba Kyari to the United States of America.

Tani noted:

On August 30, the NDLEA filed another 24 Count charges against DCP Abba Kyari just to mislead the general public and tarnish his image despite the same matter being before Federal High Court in Maiduguri and without any evidence linking Abba Kyari to any of those properties or any link to any drug money, stealing government money or any proceed of any crime.

The lawyer insisted that all the allegations on monies and properties by NDLEA belonging to Abba Kyari were false, untrue and lies, just to mislead the public into wrongly believing that they belong to Abba Kyari.

The statement read:

The businessmen who own those properties and gave their documents have already filed their cases against NDLEA in Federal High Court Maiduguri. The NDLEA without any evidence went and marked innocent people’s properties in Maiduguri and Abuja in April 2022 and released the news to the media which went viral April 2022.

These whole properties matter is before Federal High Court in Maiduguri but NDLEA is still desperate by trying to link Abba Kyari without any evidence to financial crimes and properties that do not belong to him, neither is there one kobo of drug money or any crime money that is linked to Abba Kyari in any way.

We challenge NDLEA to release the evidence to the public immediately if any. The whole thing is only aimed at media trials as they have no evidence to show to the court. If they have the evidence, let them release it to the media. This is how all their cases will crumble in the courts since their aim is only a media trial.

Osun State Governorship Election Petition Tribunal will on October 26 begin a full hearing of the petition filed by Governor Adegboyega Oyetola of the All Progressives Congress (APC) against the declaration of Senator Ademola Adeleke as governor-elect.

Lifestyle Nigeria reports that the tribunal made this pronouncement after concluding the pre-hearing session on Thursday.

The tribunal was asked to dismiss the applications of the Peoples Democratic Party (PDP) and the Independent National Electoral Commission (INEC), seeking the discontinuation of the petition brought to it by Governor Oyetola.

Counsel for Oyetola and the APC, Lasun Sanusi, SAN, at the sitting of the tribunal argued that Adeleke’s, PDP’s and INEC’s reliance on a Federal Court High judgment was nothing but an abuse of court process.

Sanusi argued this while replying to separate applications of the trio, seeking the dismissal of the petition based on the already appealed Federal High Court judgment disqualifying Oyetola from contesting the election.

Citing Supreme Court decisions in the case of Jegede Vs INEC, 2021, 14NWLR, Pt 1797, page 409, the counsel said the court had ruled that the signatories to the letter conveying the nomination of a candidate were not the nominators; rather, the nomination was done by party members at the congress, hence, the judgment could not stand.

Meanwhile, the counsel for INEC, Prof. Paul Ananaba, SAN; counsel for Adeleke, Onyechi Ikpeazu, SAN and counsel for the PDP, Dr. Alex Izinyon, SAN, agreed that any decision the tribunal would take on the matter would have to wait until the Appeal Court and the Supreme Court decided on it.

They noted that they just decided to argue the applications to have it on record, a position which the tribunal agreed with and put on record.

Also, in other applications totalling nine by the three respondents, they asked the tribunal to strike out some paragraphs of the petition on the grounds that they were either lumped together or not related to the 2022 election.

In response to each of the applications, Sanusi said all the cases cited by the respondents were misconceived, adding that they were not applicable in the instance case.

He cited the case of INEC Vs Otti, 2016, 8NWLR, where the Supreme Court hinted that INEC was supposed to be neutral, arguing that all the processes filed before the panel have not portrayed the commission’s neutrality.

Sanusi further argued that the applications filed by the respondents were only meant to prevent the tribunal from focusing on hearing the petition on merit, asking the panel to dismiss the applications.

Subsequently, counsel for all parties in the matter agreed to begin the full hearing starting with the calling of witnesses on October 26.

In his ruling, the tribunal declared the pre-hearing session concluded and announced that the pre-hearing conference report would be presented on October 17.

The remains of Flight Lieutenant Chapele Ebiakpo, one of the pilots of the NAF Alpha-Jet aircraft that crashed in Maiduguri, Borno state on March 31, 2021, have been laid to rest.

 

It will be recalled that the Nigerian Air Force fighter jet was declared missing on 31 March 2021 after losing radar contact. The crash site was later discovered and the bodies of the two pilots onboard the ill-fated jet were recovered. The pilots were on the battlefield fight Boko Haram members when the jet crashed.

 

On Thursday, October 13, friends and family members of the Late Ebiakpo gathered together at the National Military cemetery to bid him farewell. May his soul rest in peace, Amen.
