Wike Signs Instrument To Derecognise Omehia As Former Governor – Lifestyle Nigeria ?News Update
Rivers State governor, Nyesom Ezenwo Wike has signed a legal instrument into law, to derecognise Sir Celestine Omehia as a former governor of the State, and with it cancelling accruable rights and benefits.
Governor Wike signed the instrument at the Executive Council Chambers of the Rivers State Government House, Port Harcourt on Friday when it was presented to him by the State Attorney General and Commissioner of Justice, Professor Zacchaeus Adangor.
The governor disclosed that he had always respected resolutions from the State House of Assembly and never had any reason to disagree with them.
“Yesterday, I received a resolution from the Assembly de-recognising Sir Celestine Omehia, who had enjoyed the privileges of a former governor of the State.
“But you will recollect that sometime in 2007/2008, my predecessor, His Excellency Chibuike Amaechi did not recongnise Sir Celestine Omehia as a former governor of the State.
“When we came on board, there were issues and the Assembly felt that, having served as governor, he should enjoy the status of a former governor. I’ve always respected the resolutions of the Assembly. I’ve never one day disagreed with anything the Assembly has sent to me.”
Governor Wike pointed to the reasons adduced by the leader of the Rivers State House of Assembly that the strength of the information they have now had compel them to reverse what they did in 2015.
The governor noted that to be the hall mark of leadership, being able to acknowledge that there was error done in the course of administration and having the courage to correct such error.
“The leader of the house said they have better facts and what are the facts? The facts are the Supreme Court judgment categorically stated that Sir Celestine Omehia was never a governor, because he never stood for any election and that it will be inappropriate for their (assembly) legacy that they didn’t respect the judgement of the Supreme Court.”
“In this part of our country, people will praise you when it suits them, but when you do the uncommon thing, people will not praise you.”
Governor Wike stressed the need why people should keep politics away from the decision to derecognise Omehia. Governor Wike further urged people to get a copy of the Supreme Court judgment and understand that it is the right thing to derecognise Omehia in the eye of the law.
“I had to call the Attorney General for him to give me his legal opinion as regards the resolution of the Assembly, and rightly the Attorney General said they (assembly) are right.
“That in the first instance, the recognition was extra-judicial, that the Assembly has no power to change the judgment of any court, not to talk about the Supreme Court. So, people should understand and not to begin to play politics.”
Governor Wike explained as untrue that the insinuation in the media that Sir Celestine Omehia was derecognised because he had ceased to be his ally, and now a member of the presidential campaign council of the Peoples Democratic Party (PDP).
He stated the Assembly had woken to conscience and did not want posterity to blame them for an error they had done which they could correct.
Governor Wike likened it to the position members of the National Assembly also found themselves when they were working on the Electoral Amendment Bill.
“Remember, last time, the National Assembly, when they were making the amendment of the Electoral Act, everybody said they should include the card reader and that was in 2018/2019.
“The National Assembly did not do it, particularly, the All Progressives Congress (APC) members and people told them what they were doing will hunt them. Posterity will not forgive you if you do not allow democracy to thrive.
“In the new Electoral Amendment Act, because they knew they did not do the right thing, they had to include it and you can see that members of the National Assembly are happy that they have done the right thing.”
Governor Wike also pointed to the sum of money paid to Sir Celestine Omehia as a proof against those who peddled tales that government does not pay such benefits at all.
“If this did not happen, nobody will even know that the State government has been coughing out such amount of money to pay as benefits.
“I’m sure, they must have told you that no benefits and all entitlements were never paid, that is what you hear everywhere.
“But yesterday, when it was revealed that the State government coughed out such amount of money to pay as benefits as recommended by the Assembly and now, they have sent the resolution to me, I thank God today, without looking back, I have signed it as instrument and it will be gazetted for record purposes.”

Osun State Governorship Election Petition Tribunal will on October 26 begin a full hearing of the petition filed by Governor Adegboyega Oyetola of the All Progressives Congress (APC) against the declaration of Senator Ademola Adeleke as governor-elect.
Lifestyle Nigeria reports that the tribunal made this pronouncement after concluding the pre-hearing session on Thursday.
The tribunal was asked to dismiss the applications of the Peoples Democratic Party (PDP) and the Independent National Electoral Commission (INEC), seeking the discontinuation of the petition brought to it by Governor Oyetola.
Counsel for Oyetola and the APC, Lasun Sanusi, SAN, at the sitting of the tribunal argued that Adeleke’s, PDP’s and INEC’s reliance on a Federal Court High judgment was nothing but an abuse of court process.
Sanusi argued this while replying to separate applications of the trio, seeking the dismissal of the petition based on the already appealed Federal High Court judgment disqualifying Oyetola from contesting the election.
Citing Supreme Court decisions in the case of Jegede Vs INEC, 2021, 14NWLR, Pt 1797, page 409, the counsel said the court had ruled that the signatories to the letter conveying the nomination of a candidate were not the nominators; rather, the nomination was done by party members at the congress, hence, the judgment could not stand.
Meanwhile, the counsel for INEC, Prof. Paul Ananaba, SAN; counsel for Adeleke, Onyechi Ikpeazu, SAN and counsel for the PDP, Dr. Alex Izinyon, SAN, agreed that any decision the tribunal would take on the matter would have to wait until the Appeal Court and the Supreme Court decided on it.
They noted that they just decided to argue the applications to have it on record, a position which the tribunal agreed with and put on record.
Also, in other applications totalling nine by the three respondents, they asked the tribunal to strike out some paragraphs of the petition on the grounds that they were either lumped together or not related to the 2022 election.
In response to each of the applications, Sanusi said all the cases cited by the respondents were misconceived, adding that they were not applicable in the instance case.
He cited the case of INEC Vs Otti, 2016, 8NWLR, where the Supreme Court hinted that INEC was supposed to be neutral, arguing that all the processes filed before the panel have not portrayed the commission’s neutrality.
Sanusi further argued that the applications filed by the respondents were only meant to prevent the tribunal from focusing on hearing the petition on merit, asking the panel to dismiss the applications.
Subsequently, counsel for all parties in the matter agreed to begin the full hearing starting with the calling of witnesses on October 26.
In his ruling, the tribunal declared the pre-hearing session concluded and announced that the pre-hearing conference report would be presented on October 17.
